Terms & Conditions

Your completion and submission of the application form is confirmation that you have read and accepted the terms of the application as follows::

1. ONLY the parent or legal guardian of children aged between birth to 5 years and 364 days of age may apply (as at December 31st 2008). Proof of age of the child or children selected to appear in the book may be requested. More than one child per family may apply - only one application per child may be submitted. Each separate application ensures each child appears on its 'own' page(s) in the book. 2. The successful applicant must be available for a photo session in Melbourne (currently Albert Park) 3.Applications are only cancelled if: [a] the book is over subscribed with entries [b] the child/children age does not meet the criteria 4. A $75.00 participation fee is required to be paid at the time of application. Unless your application is cancelled due to oversubscription (3[a] ) then your participation fee is non-refundable and non-transferable. The participation fee is donated entirely to SIDS and Kids Victoria. 5. After the portrait session you will have the opportunity to view and purchase the art captured on the day. There is no obligation for you to purchase any of the images. 6. You may pre-purchase any number of copies of the book “Five & Under” by selecting the 'Buy Now' button on this page. There is no obligation for you to purchase the book. 7. The book `Five and Under' is a limited release, all books sold will be personally signed and numbered by Brett Jacques. The book is planned for release in February 2009. Retail price for this book will be $99.95 with profits from the book going to SIDS and Kids Victoria. 8. Image selection for publication, final layout and artwork will be at the discretion of the organisers. All due care will be taken to ensure all children chosen to appear in the book will have the correct spelling of their first name, and correct age. However, no liability will be taken for omission or mistakes. 9. Agreement of Assignment of Copyright in consideration of SIDS and Kids Victoria, Brett Jacques Photography Pty Ltd, Clownfish Publishing Pty Ltd agreeing to publish one or more photographs of my child/children in the Book that is subject of this promotion, you agree, as legal guardian of the child/children to assign absolutely to the aforementioned companies the entire copyright throughout the world (including all renewals and extensions) and any future copyright and all other rights of a like nature which may now or in the future subsist in respect of any of the photographs taken of your child. 10. Privacy Policy: SIDS and Kids, Clownfish Publishing Pty Ltd, Brett Jacques Photography Pty Ltd will not share your details with any other agency or person
